Although we are living in a digital age, the fact is that discrimination in the workplace is still present. Employment discrimination makes a work atmosphere in which the employees are exposed to discrimination. In worst case scenarios, the employees who are victims of these unlawful activities may lose their jobs. So, what can we do in situations like this?
If there is something positive about situations like this, that’s the ability to protect yourself by filing claims. In case and employee or job applicant believes that she or he have experienced job discrimination, they should follow our tips that will help them successfully present their discrimination claim. The fact is that every employee will pay closer attention and revise their decision if there are strong arguments on the employee’s side.
  1. The employee must know and fully understand the rules and requirements of their employer in the moment when they believe that they are discriminated. So, what does this really mean? In case the employee wishes her or his claims to be viewed as serious by their supervisor, they must present the employment discrimination claim in front of the employer in a proper way. In case the employee has acknowledged and followed the rules of their company, they they are in a much better situation because they can demand that the employer practices the same company’s rules. This means that they have to resolve these claims in a timely manner described in company’s rules.

  2. Try to find out whether the employer is aware of the current and prospective employment discrimination cases. This is quite simple – an employer cannot take any measures and activities if they don’t know that there are discrimination claims made by some employees.

  3. It is a good idea to record the claims and all the actions you’ve made during this period in order to resolve the issue. The vast majority of employers won’t be prepared to take any actions related to employment discrimination in a situation where they don’t have credible claims supported by authentic proof in front of them. So, the employee should keep a precise record of all the incidents they have experienced. In order to create credible records, you should write down the time, location and the names of all the individuals involved in these incidents and the witnesses. In addition, the employee or the applicant should also write down the activities and actions they have used to solve the problems. For instance, they should keep records of all the conversations they had with the employer or supervisor. This is a good way to prove that this problem is serious and that the actions of some supervisors have made the employee feel discriminated.

  4. In case the worker has any physical evidence of the possible discrimination or harassment, they should save it and store it in a safe place. This evidence often includes delicate pictures, objects and videos. This will certainly be helpful for their claims.

  5. Finally, it is a good idea to look for help from EEOC (Equal Employment Opportunity Commission). This federal agency is focused on solving employment discrimination cases. There are also state equal employment agencies that can help the employees.
